These Terms & Conditions apply to purchases made from Hollywood Nails Supply through our website, by telephone, or by any other method through which we accept an order.
Hollywood Nails Supply is operated by Hollywood Nails & Beauty Supplies Ltd. Our registered office is 29A Peckham High Street, London, SE15 5EB.
By placing an order with us, you agree to these Terms & Conditions. Nothing in these Terms & Conditions affects any statutory rights that you may have as a consumer.
1. Orders
Orders can be placed through our website or by telephone.
After placing an online order, you will normally receive an automated order confirmation. This confirms that we have received your order but does not necessarily mean that your order has been accepted.
We reserve the right to refuse or cancel an order where, for example:
- a product is unavailable;
- there has been an obvious pricing, product information or promotional error;
- payment cannot be authorised;
- we are unable to deliver to the address provided;
- supplying the product to the destination would breach applicable laws or regulations; or
- we reasonably suspect fraudulent activity or misuse of our website.
Where we cancel an order before dispatch, any payment taken for the cancelled goods will be refunded.
2. Prices and VAT
Prices are displayed in pounds sterling unless otherwise stated.
VAT will be charged where applicable and the total amount payable will be displayed before the order is confirmed.
Delivery charges are additional unless expressly stated otherwise and will be displayed at checkout.
We make reasonable efforts to ensure that prices are correct. If an obvious pricing error occurs, we may contact you before dispatch to offer the option of proceeding at the correct price or cancelling the affected item or order.
3. Product Information and Colours
We take reasonable care to ensure that product descriptions, photographs, colour swatches and other information displayed on our website are accurate.
However, colours may appear differently depending on photography, lighting conditions, screen settings, device displays and manufacturing batches. Images and colour swatches should therefore be regarded as a reasonable representation of the product rather than a guarantee that the colour displayed on a screen will be identical in all circumstances to the physical product.
This does not affect your statutory rights where goods are faulty, materially not as described or otherwise do not conform to the contract.
4. Product Ingredients and Professional Products
Customers should check product ingredients, instructions, warnings and manufacturer guidance before use, particularly where they have allergies, sensitivities or specific professional or regulatory requirements.
Some products sold by Hollywood Nails Supply are intended for professional use. Professional users are responsible for ensuring that they are appropriately trained and that products are used in accordance with applicable instructions and professional requirements.
Ingredients and formulations may be updated by manufacturers from time to time. Where a particular ingredient or formulation is essential to your purchase, please contact us before ordering if you require confirmation.
5. Delivery
Available delivery services and their charges will be shown at checkout.
We aim to dispatch orders promptly. Estimated dispatch and delivery times are estimates unless we expressly agree a guaranteed delivery date.
Orders placed before our stated dispatch cut-off may normally be dispatched on the same working day, subject to payment authorisation, stock availability and operational capacity.
We do not normally dispatch on weekends or UK bank holidays.
Customers are responsible for providing a complete and accurate delivery address. Additional costs arising from an incorrect or incomplete address supplied by the customer may, where permitted by law, be charged to the customer.
6. International Orders, Customs and Import Charges
Orders delivered outside the United Kingdom may be subject to customs duties, import VAT, brokerage charges, clearance fees or other taxes and charges imposed by the destination country.
Unless expressly stated at checkout that these charges have been prepaid by Hollywood Nails Supply, all customs duties, import taxes and local clearance charges are the responsibility of the recipient and are not included in our product or delivery prices.
Customers are responsible for checking any applicable import requirements before placing an order.
Customs authorities or delivery companies may contact the recipient directly to request payment before releasing a shipment.
Refusal or Non-Payment of Import Charges
If an international shipment cannot be delivered because the recipient refuses or fails to pay customs duties, import taxes or other charges for which they are responsible, the shipment may be returned to us by the carrier.
Once the goods have been returned to us, we will process any refund due in accordance with applicable consumer law.
Where permitted by applicable law, we reserve the right to deduct from the refund any actual, reasonable and non-recoverable costs incurred as a direct result of the customer’s refusal or failure to accept the shipment, including return-to-sender charges, customs charges or carrier administration charges.
Any statutory right to reimbursement of the standard outbound delivery charge will be honoured where applicable.
If a parcel is abandoned, destroyed or otherwise not returned to us as a result of the recipient’s refusal to pay applicable charges, any refund will be considered in accordance with the customer’s applicable statutory rights and the circumstances of the shipment.
7. International Product Compliance
Our products are primarily supplied for the Great Britain market.
Products which may lawfully be supplied in Great Britain are not necessarily authorised for sale, professional use or importation in every other country or territory.
We may therefore restrict particular products or product ranges from being delivered to certain destinations.
Nothing in these Terms & Conditions excludes any legal obligation that applies to Hollywood Nails Supply when we sell or supply products into a particular jurisdiction.
8. Northern Ireland
Northern Ireland is subject to certain regulatory requirements which differ from those applying in Great Britain, including requirements relating to cosmetic products.
As a result, certain products available for purchase in England, Scotland and Wales may not be available for delivery to Northern Ireland.
We reserve the right to remove restricted products from an order or cancel an order where a product cannot lawfully be supplied to the delivery destination. Any payment made for an item that we cancel will be refunded.
9. Consumer Right to Cancel Online and Distance Orders
If you are purchasing as a consumer by website, telephone or another distance-selling method, you will generally have the right to cancel your purchase without giving a reason.
You must notify us of your decision to cancel within 14 days beginning on the day after you receive the goods, subject to any applicable statutory exceptions.
After notifying us that you wish to cancel, you normally have a further 14 days to return the goods.
You may inspect goods to the extent reasonably necessary to establish their nature, characteristics and functioning. Where goods have been handled beyond what would reasonably be permitted when examining them in a shop, we may make a deduction from the refund for any reduction in value where permitted by law.
Where a valid cancellation applies, we will refund the price paid for the returned goods and the cost of our least expensive standard delivery service where required by law.
If you selected an enhanced or premium delivery service, we are not required to refund the additional amount above our standard delivery charge.
Unless the goods are faulty, incorrect, not as described, or we have agreed otherwise, the customer is normally responsible for the direct cost of returning goods following a change-of-mind cancellation.
10. Sealed Goods and Hygiene
Certain sealed products may not be eligible for a change-of-mind return once unsealed where they are not suitable for return for health protection or hygiene reasons and the applicable statutory exception applies.
Where relevant, customers wishing to exercise a change-of-mind cancellation should therefore keep products sealed until they have decided whether they wish to keep them.
This restriction does not affect statutory rights in relation to products which are faulty, unsafe, incorrect or not as described.
11. Faulty, Incorrect or Not-as-Described Goods
If goods are faulty, damaged, incorrect, not as described or otherwise fail to meet your statutory rights, please contact us as soon as reasonably possible with your order details and information about the problem.
Where appropriate, we may ask for photographs or other reasonable information to help us investigate the issue.
Your legal rights in relation to faulty or non-conforming goods are separate from our change-of-mind returns policy and are not affected by requirements for goods to be unopened or unused.
Where we are responsible for goods being faulty, incorrect or not as described, we will provide an appropriate remedy in accordance with applicable law and will bear reasonable return costs where required.
12. Refunds
Where a refund is due, it will normally be made to the original payment method.
For valid consumer cancellations, refunds will be made within the applicable statutory timeframe. We may, where permitted by law, withhold the refund until the returned goods have been received or until evidence has been provided that the goods have been sent back, whichever occurs first.
Refund processing times after we issue a refund may vary depending on the customer’s bank or payment provider.
13. Non-Receipt of Goods
If an order has not arrived when expected, please contact us as soon as possible so that we can investigate with the carrier.
We ask customers to report non-receipt within 60 days of the order date wherever possible so that courier records remain available and an effective investigation can be carried out.
This notification period does not exclude or restrict any statutory rights that cannot legally be limited.
14. Business and Wholesale Customers
Where an order is placed wholly or mainly for purposes relating to a customer’s trade, business, craft or profession, the customer may be treated as a business customer rather than a consumer.
Consumer cancellation rights do not necessarily apply to business-to-business transactions.
Separate wholesale, distributor, credit-account or supply terms may apply where these have been agreed with a business customer. Where separate written terms have been agreed, those terms will take precedence to the extent that they conflict with these general Terms & Conditions.
15. Intellectual Property
The text, photographs, graphics, branding, product presentation, databases and other content appearing on our website are protected by copyright, trademark and other intellectual property rights belonging to Hollywood Nails Supply, our suppliers or other rights holders.
Website content may be used for personal, non-commercial purposes only unless we have given written permission for another use.
16. Website Information and Availability
We endeavour to keep our website accurate and available, but we cannot guarantee that it will always operate without interruption or that every piece of information will always be completely free from error.
Nothing in this section limits our responsibilities where applicable law requires information supplied to consumers to be accurate.
17. Liability
Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or statutory consumer rights that cannot legally be excluded.
Subject to applicable law, we will not be responsible for losses which were not reasonably foreseeable when the contract was formed.
Different limitations may apply to business customers where separately agreed in writing.
18. Changes to These Terms
We may update these Terms & Conditions from time to time.
The terms applicable to an order will normally be those published on our website at the time the order is placed. Updating these Terms & Conditions will not retrospectively alter an existing contract unless required by law or agreed with the customer.
The date of the latest revision will be displayed at the top of this page.
19. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
If you are a consumer resident elsewhere, you may also benefit from mandatory protections provided by the laws applicable to you which cannot lawfully be excluded by these Terms & Conditions.
Nothing in these Terms & Conditions is intended to deprive a consumer of mandatory legal rights applicable to them.
